These terms apply to your use of our website and to any professional services provided by COMFINTAX, except where a separate signed engagement letter or agreement governs a specific engagement — in which case that document prevails to the extent of any conflict.

2. Nature of our services

COMFINTAX provides professional advisory services across compliance, finance and taxation, including accounting and taxation, virtual CFO, secretarial compliances, business valuation, fundraising, risk assurance and corporate legal advisory. The precise scope, deliverables and fees for any engagement are set out in an engagement letter agreed with you.

3. No advice without an engagement

The content on this website is provided for general information only. It does not constitute professional, financial, tax, legal or investment advice, and should not be relied upon as such. No client relationship is created by your use of this website. You should obtain specific professional advice before acting on any information here.

4. Engagement, scope and fees

Services are provided on the basis of the scope agreed in the relevant engagement letter. Fees, billing and payment terms are as set out in that engagement letter. Unless stated otherwise, fees are exclusive of applicable taxes (including GST) and of third-party, statutory and out-of-pocket costs, which are charged in addition.

5. Your responsibilities

You agree to provide accurate, complete and timely information and documents, and to give us the access and cooperation we reasonably need to perform our services. We rely on the information you provide and are not responsible for consequences arising from information that is inaccurate, incomplete or provided late. You are responsible for meeting your own statutory and regulatory obligations except where we have expressly agreed to do so.

6. Professional standards

We perform our services with reasonable skill and care and in accordance with applicable professional standards and regulations. We maintain our independence and objectivity in the conduct of our engagements.

7. Confidentiality

Each party will keep the other’s confidential information confidential and use it only for the purposes of the engagement, except where disclosure is required by law, regulation or a competent authority, or is permitted under the engagement letter.

8. Intellectual property

All content on this website — including text, graphics, the COMFINTAX name and marks, and the design system — is owned by or licensed to COMFINTAX and is protected by applicable laws. You may not reproduce, distribute or create derivative works from it without our prior written consent. Ownership of deliverables produced during an engagement is dealt with in the engagement letter.

9. Third-party links

Our website may contain links to third-party websites or tools (including our technology partner). We provide these for convenience and are not responsible for the content, policies or practices of third-party sites.

10. Limitation of liability

To the maximum extent permitted by law, COMFINTAX will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, goodwill or data, arising out of or in connection with your use of this website or our services. Our total aggregate liability in connection with any engagement is limited as set out in the relevant engagement letter. Nothing in these terms limits any liability that cannot be limited under applicable law.

11. Indemnity

You agree to indemnify COMFINTAX against claims, losses and costs arising from your breach of these terms or from inaccurate or incomplete information you provide, except to the extent caused by our negligence or wilful default.

12. Data protection

We handle personal data in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023. By using our website or services, you acknowledge our Privacy Policy.

13. Governing law and jurisdiction

These terms are governed by the laws of India. Subject to any dispute-resolution mechanism agreed in an engagement letter, the courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising out of or in connection with these terms or our services.

14. Changes to these terms

We may update these terms from time to time. The “last updated” date above indicates when they were last revised. Continued use of the website or our services after a change constitutes acceptance of the updated terms.
